TERMS OF SERVICE

1. OVERVIEW

This website is operated by The MX Factory (“Company,” “we,” “us,” or “our”). Throughout the site, the terms “you” and “your” refer to the user, customer, or participant.

By visiting our website, purchasing a product or service, registering for a camp or clinic, or accessing any content provided by The MX Factory (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, you may not access or use our Services.

These Terms apply to all users of the site, including but not limited to browsers, customers, riders, parents, vendors, and content contributors.

Our store is hosted on Shopify Inc., which provides the e-commerce platform enabling us to sell our products and services.

2. ELIGIBILITY & AGE REQUIREMENTS

By using our Services, you represent that:

  • You are at least 18 years of age, OR

  • You are the legal parent or guardian of a minor participant and consent to these Terms on their behalf.

Parents and guardians assume full responsibility for minors registered for camps, clinics, or training.

3. ASSUMPTION OF RISK

Motocross and off-road motorcycle riding are inherently dangerous activities involving risk of serious injury, permanent disability, or death.

By purchasing or participating in any MX Factory service, you acknowledge and voluntarily assume all risks associated with:

  • Riding motorcycles

  • Training activities

  • Track conditions

  • Weather conditions

  • Mechanical failures

  • Third-party actions

  • Travel to and from events

Participation is voluntary and undertaken at your own risk.

You agree that The MX Factory is not responsible for injuries, accidents, equipment damage, or loss arising from participation.

Participants are responsible for ensuring their own medical insurance coverage.

4. PRODUCTS & SERVICES

We offer:

  • In-person motocross camps and clinics

  • Private training sessions

  • Online training courses

  • Digital products

  • Merchandise

All product descriptions, pricing, availability, and schedules are subject to change at any time without notice.

We reserve the right to:

  • Limit quantities

  • Refuse service

  • Cancel orders

  • Modify programs

  • Adjust schedules

  • Change locations when necessary

All decisions are at the sole discretion of The MX Factory.

5. PAYMENT TERMS

All purchases must be paid in full at the time of registration unless otherwise stated.

We reserve the right to:

  • Refuse or cancel orders

  • Limit quantities per customer

  • Cancel suspected reseller or fraudulent transactions

You agree to provide accurate billing and account information.

Chargebacks initiated without first contacting us to resolve disputes may result in permanent banning from future registrations.

6. REFUND, WEATHER & CREDIT POLICY

All refunds, cancellations, weather interruptions, credits, and guarantees are governed by our official Refund & Weather Policy, which is incorporated into these Terms by reference.

By completing a purchase, you agree to that policy in full.

7. DIGITAL CONTENT

All online courses and digital products are proprietary intellectual property.

You may not:

  • Share login credentials

  • Copy, reproduce, or distribute materials

  • Record training sessions

  • Resell content

  • Use content for commercial purposes without written consent

Violation may result in immediate termination of access without refund.

8. INTELLECTUAL PROPERTY

All content on this website and within MX Factory programs — including logos, videos, course materials, training systems, curriculum frameworks, trademarks, and branding — are the exclusive property of The MX Factory.

Unauthorized reproduction, distribution, or use is strictly prohibited.

9. MEDIA RELEASE

By participating in any MX Factory event, you grant The MX Factory the right to:

  • Photograph

  • Film

  • Record

  • Use your likeness, name, and voice

For marketing, promotional, educational, and commercial purposes worldwide without compensation.

If you wish to opt out of media use, written notice must be provided before the event.

10. THIRD-PARTY TOOLS & LINKS

Our Services may include links to third-party websites, tracks, facilities, sponsors, or service providers.

We are not responsible for:

  • Third-party content

  • Facility conditions

  • Insurance policies

  • Business practices

  • Products or services offered by third parties

Use of third-party services is at your own risk.

11. DISCLAIMER OF WARRANTIES

All Services are provided “as is” and “as available.”

We do not guarantee:

  • Specific performance outcomes (except as stated in our written guarantee terms)

  • Uninterrupted access to online content

  • Weather conditions

  • Track availability

  • Event completion due to force majeure

We disclaim all implied warranties to the fullest extent permitted by law.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law, The MX Factory, its owners, officers, employees, contractors, affiliates, and agents shall not be liable for:

  • Personal injury

  • Property damage

  • Lost income

  • Travel expenses

  • Mechanical failures

  • Indirect or consequential damages

In any event, our total liability shall not exceed the amount paid for the specific service in question.

Some states may not allow certain limitations; liability shall be limited to the maximum extent permitted by applicable law.

13. INDEMNIFICATION

You agree to indemnify and hold harmless The MX Factory from any claims, damages, liabilities, legal fees, or expenses arising from:

  • Your participation

  • Your breach of these Terms

  • Your violation of law

  • Claims brought by third parties related to your actions

14. TERMINATION

We reserve the right to:

  • Deny service

  • Remove participants from events

  • Terminate access to digital content

  • Cancel registrations

If behavior is unsafe, disruptive, unlawful, or harmful to other participants.

No refunds will be issued in cases of removal for misconduct.

15. FORCE MAJEURE

We are not liable for failure to perform due to circumstances beyond our control, including but not limited to:

  • Severe weather

  • Natural disasters

  • Pandemics

  • Government restrictions

  • Facility closures

  • Facility negligence

  • Travel disruptions

  • Acts of God

16. GOVERNING LAW & VENUE

These Terms shall be governed by and construed in accordance with the laws of the State of Texas.

Any disputes arising from these Terms or Services shall be resolved exclusively in state or federal courts located in Texas.

You consent to personal jurisdiction in Texas.

17. CHANGES TO TERMS

We reserve the right to update or modify these Terms at any time.

Continued use of our Services after changes are posted constitutes acceptance of those changes.

18. ENTIRE AGREEMENT

These Terms, together with our Refund & Weather Policy and Privacy Policy, constitute the entire agreement between you and The MX Factory.
